Where can I find the full texts of the Maryland False Claims Act and the Maryland False Health Claims Act?
The Maryland False Claims Act (“MFCA”) is written into Maryland statutes at Md. Code Ann. Gen. Prov. § 8-101, et seq. Prior to 2015, Maryland had the Maryland False Health Claims Act (“MFHCA”) which applied only to Medicaid and healthcare-related claims. The MFHCA is written into Maryland statutes at MD Health-Gen Code § 2-601, et seq.
What kind of fraud is covered by the Maryland False Health Claims Act and the Maryland False Health Claims Act?
The MFCA applies to any claim made to the state, a county or a municipal corporation, including claims related to Maryland Medicaid, general procurement, transportation, education, construction or other state-funded programs.
Prior to 2015, Maryland only had the MFHCA, which applies to false claims made related to the Maryland Medicaid program. Since the broader MFCA was enacted, a civil action related to Medicaid fraud can be brought under the MFCA or the MFHCA, but not both.
