The New York False Claims Act (“NYFCA”) is written into New York statutes at N.Y. Fin. Law §§ 187 – 194 and also includes procedural regulations which are found at N.Y. Comp. Codes R. & Regs. tit. 13, §§ 400.1 – 400.8.
What kind of fraud is covered by the New York False Claims Act?
The NYFCA applies to any claim made to the state or any county, city, town, village, municipality, school district, board of cooperative education services, local public benefit corporation, or other political subdivision of the state or local government, including claims related to Medicaid, procurement, or construction contracts. The claims may relate to New York Medicaid, general procurement, transportation, education, construction or other state-funded programs.
