Where can I find the full text of the Tennessee False Claims Act and the Tennessee Medicaid False Claims Act?
Tennessee has two statutes that prohibit false claims to the state. The Tennessee False Claims Act (“TFCA”) is written into Tennessee statutes at Tenn. Code Ann. §§ 4-18-101 through 4-18-108. The Tennessee Medicaid False Claims Act (“TMFCA”) is written into the Tennessee statutes at Tenn. Code Ann. §§ 71-5-181 through 71-5-185.
What kind of fraud is covered by the Tennessee False Claims Act?
The TFCA applies to any claim made to the state or any city, town, municipality, county or other legally authorized local government entity, including claims related to general procurement, transportation, education, construction or other state-funded programs except for claims related to Medicaid.
Any false or fraudulent claims related to TennCare, Tennessee’s Medicaid program, must be addressed by the TMFCA.
